OmniPhoto Referral Program

1. Eligibility & Account Approval

• Free Enrollment: Joining the Program is completely free.
• Approval Process: Submitting a signup request does not guarantee entry. OmniPhoto reserves the right to approve or deny any referrer application at our sole discretion.
• Active Status: You will only receive a unique referral code and become eligible for commissions once your application has been officially approved by us.

2. Qualifying Referrals

To earn a commission, a referral must meet all of the following criteria:

• The referred client must be a new client to OmniPhoto (they cannot have booked services with us previously).
• The referred client must explicitly provide your unique referral code or your full name at the time of their initial booking/inquiry. Retroactive referral claims will not be honored.
• The referred client must sign a photography contract and pay their invoice in full.

3. Tiered Commission Structure

Commissions are performance-based and divided into three tiers:

How Commission is Calculated: Commissions are calculated strictly on the base package price before taxes (GST/HST/PST) and excluding any external overhead costs (such as travel fees, permits, second-shooter labor, or third-party physical album printing).

4. Payout Terms & Timing

• No Automatic Payouts: Payouts are calculated and managed manually.
• The "Clearance" Window: Commissions are only deemed "earned" once the photography session has been successfully completed, and the client’s invoice has been paid in full.
• Method of Payment: Once a payout is earned, OmniPhoto will contact you to issue payment via Interac e-Transfer or Cash.
• Processing Time: Payouts will be initiated within 14 to 30 business days following the completion and full payment of the referred job.

5. Canadian Tax Compliance (CRA)

• Independent Contractor Status: As a Referrer, you are an independent contractor, not an employee of OmniPhoto. You are solely responsible for reporting these earnings on your personal taxes.
• The $500 T4A Rule: In compliance with the Canada Revenue Agency (CRA), if your total referral earnings exceed $500 CAD within a single calendar year, OmniPhoto is legally required to issue you a T4A tax slip.
• To facilitate this, you agree to provide your full legal name, current mailing address, and Social Insurance Number (SIN) upon request once your earnings approach or exceed this threshold. Failure to provide this information will result in a suspension of payouts.

6. Ethical Promotion & Disclosures

• Transparency: Under Canadian Consumer Protection laws and Competition Bureau guidelines, you must disclose to people you refer that you receive a financial commission if they book.
• No Spamming: You may not post your referral links or codes on coupon sites, spam public forums, or use aggressive, misleading marketing tactics.
• Brand Representation: You may not represent yourself as an employee, partner, or official spokesperson of OmniPhoto.
